Trigger Laws
Several states, including South Dakota, have laws on the books that are designed to outlaw abortion if the Supreme Court overturns Roe v. Wade. These are essentially abortion bans that would be “triggered” by such an anti-choice decision by the Court. If Roe v. Wade is overturned, South Dakota Codified Law 34-23A-3 would outlaw all abortions except for those judged medically necessary by the woman’s physician.
